Malaysia Trademark registration is not mandatory, you may use your trademark without registration. However, it is highly recommended that you protect your trademark in Malaysia by registration.
We will file your trademark application with the Intellectual Property Corporation of Malaysia (MyIPO). The application will then be examined by the Examiner with formality checks and substantive examination. If there is no conflicting mark found by Registrar, your trademark application will be accepted for registration in Malaysia.
However, If the Registrar found any mark that is similar to yours, your application will be objected to after the examination process. The applicant must respond to the objection within a stipulated time, or else the application will be deemed abandoned. If the application is accepted, it will be published in the Official Journal. Any interested party may oppose the registration of your trademark within 2 months of the publication date. If there is no opposition from any 3rd party, the mark will be registered and the registration certificate will be issued.
The processing time from the filing date to the registration of the trademark in Malaysia may take about 9 – 12 months. However, if there is an objection from the trademark office or opposition from anyone else, it may take longer.
